Summary

As of September 2021, property owners' associations in Texas with 60 units or more, or those maintained by a management company, are required to have websites which host the association's "dedicatory instruments" or "governing documents" as they are also known, along with meeting notices, policies, and more.

ONLINE SUBDIVISION INFORMATION REQUIRED
Texas Prop. Code Section 207.006

(a) This section applies only to:

  1. the property owners' association of a subdivision composed of at least 60 lots; or
  2. a property owners' association that has contracted with a management company.

(b) A property owners' association to which this section applies shall make the current version of the association's dedicatory instruments relating to the association or subdivision and filed in the county deed records available on an Internet website:

  1. maintained by the association or a management company on behalf of the association; and
  2. available to association members.

RESTRICTIVE COVENANTS
Texas Prop. Code Section 209.001 This chapter may be cited as the Texas Residential Property Owners Protection Act.

(4) "Dedicatory instrument" means each governing instrument covering the establishment, maintenance, and operation of a residential subdivision. The term includes restrictions or similar instruments subjecting property to restrictive covenants, bylaws, or similar instruments governing the administration or operation of a property owners' association, to properly adopted rules and regulations of the property owners' association, and to all lawful amendments to the covenants, bylaws, rules, or regulations.
